Privacy policy

1) Waiver Form
You agree to sign a waiver form with The Athletic Body (“TAB”).

2) Minimum age
The minimum age for training with us is 16. People under the age of 18 are required to provide written notice from a parent or legal guardian confirming approval to train with TAB.

3) Your Health
You warrant that you are in good physical condition and you know of no medical or other reason why you cannot or should not do active training or exercise.
You recognize that the fitness instructor(s) is not able to provide me with medical advice with regard to my fitness, and that this information is used as a guideline to the limitations of my ability to train/exercise. I agree to not hold any certified trainer or directors of TAB liable for any injury that may occur during an TAB training session.

4) Paying for Memberships
Membership fees are paid on a mutually agreed upon date by direct debit from a bank account or credit card.

5) Meeting Your Responsibilities
You must make sure:
a. Your account can accept direct debits
b. here is enough money in your account on the payment day
c. You tell us if you are transferring or closing your account at least 72 hours before the next direct debit
d. You tell us about any changes to your credit card, such as its expiry date or number, at least 72 hours before your next debit

6) What happens if your payment is declined or fails for any reason?
If you do not fully pay your fees on the due date, TAB will suspend your access to TAB until any outstanding balance has been paid and you have given us your updated account details if they are required. TAB will continue to debit your nominated account without notice, until TAB have received the total amount you owe TAB. TAB will make a reasonable effort to advise you on the status of the failed payments by letting you know beforehand by:a. phoning you
b. writing to the email address you provided for membership(s) in your name, you must make sure that the payment method you choose remain valid for the length of your agreement. This includes third-party accounts. If the details you give us fail, you are liable for all resulting fees. You should update your details and are obligated to complete your minimum term of payments.
Payments declined & not reconciled within 15 days will be assessed a $35 late payment fee.

7) Can TAB change your agreement?
TAB may sometimes add to, change or remove our terms and conditions. This includes changing the opening and closing hours, TAB services and facilities and membership fees. Sometimes, TAB may also close for refurbishment to improve the facilities. If this substantially reduces our ability to provide our service to you, TAB will reduce your membership fees accordingly on a pro-rata basis. The most up-to-date terms and conditions always apply. TAB will give you at least 28 days’ notice of any changes. If TAB does not fulfill our obligations to you, you may be able to cancel your membership. Unless the law states otherwise, you won’t have any other claim against us if this happens.

8. Can TAB increase your fees?
TAB reserves the right to increase your fees only after your agreement has ended. TAB will make a reasonable effort to tell you about this at least 28 days beforehand by writing to the address you last gave us (which may be an email address). TAB will consider that you have received our letter or email on the second business day after it is sent.
Where TAB have made a reasonable effort to let you know about a fee increase, you authorize us to increase any debits from your nominated account.

9. Membership Freezes (Suspensions) & Cancellations
TAB understands that from time to time you may not be able to train due to holidays, rest periods, becoming sick or injured or wish to cancel your membership altogether. The following rules apply to suspensions and cancellations:a. Account Freezes
b. Monthly Contract Commitments
c. Memberships can be frozen at any time with a minimum two week notice via e-mail.  Please note: all membership agreements will be extended to match the duration of the freeze period(s).
d. Cancellations
e. You are agreeing to the terms of this package, and the package price. You’re allowed a pro-rated refund under the following circumstances | (1) Medical disability, as confirmed by note from a medical professional | (2) You relocate to an area that is more than 25 miles from the TAB Studio, as confirmed in writing.
f. No-Term Memberships:
Cancel anytime, Minimum 2 week notice, $0 cancellation fee.
g. Contract Membership:
Cancellation fee: 50% of remainder contract value
An exit fee does NOT apply under the following circumstances:
Sickness/Injury resulting in not being able to train for the remainder of the contract (must provide Doctors certificate)
h. Any account balances not paid in full within 30 days of the payment due date will be pursued by our legal team and/or a debt collection agency.

10. Use of your image
You agree to allow TAB to take a video or photo to use for promotion purposes from time to time.

11. Dress Code Policy
We prefer and strongly recommend you come to class fully prepared for strenuous activity: enclosed running shoes, athletic shorts/pants, athletic t- shirt, towel and water bottle. We reserve the right to refuse you entrance into the studio if you are not properly attired.

12. 8 Hour Class Cancellation Policy
TAB enforces a strict 8 hour class cancellation policy. If you have reserved your place in an TAB class and fail to cancel 8 hours in advance you will be charged $10 and/or forfeit a session for the class.

13. Late Arrival Policy
TAB enforces a strict Late Arrival Policy. If you are more than 10 minutes late for class, you will lose your spot and may incur a Late Cancel Charge of $10 and/or forfeit a class session.

14. Stretching
You must be on time to class to properly stretch and warm-up prior to engaging in an TAB workout. No entry into class after 15 mins.All decisions regarding the late and cancellation policies are to be upheld at TAB’s discretion.
